What is notarisation?
Notarisation is the process of certifying documents, powers of attorney, and various certificates as true copies, allowing them to act as substitutes for the originals. This process verifies the document's authenticity and legitimacy to relevant institutions.
What is a Notary Public Lawyer?
A Notary Public is appointed by the Supreme Court of Australia. They can certify true copies and witness signatures of various power of attorneys, certificates and certifications of applicants. They are mainly used to replace the originals to prove the authenticity of the documents to relevant agencies.
Please note: A Notary Public cannot help the organiser write or review documents, and are not responsible for the content of the documents. The undertaker is obliged to find out the specific local requirements for documents and prepare relevant materials according to these requirements, to ensure that the documents are authenticated and can be used legally within the country. Additionally, if a document is to be notarised, the original document must be provided, otherwise the notarisation service cannot be effected.
What is Apostille?
Apostille is an international legal certification process. The purpose of Apostille is to prove the authenticity of documents and to enable the certified documents to be transferred and recognized among all Hague member countries. The apostille process in Australia is handled by the Australian Department of Foreign Affairs and Trade (DFAT).
The Apostille certification process
Step 1: An Australian Notary Public lawyer will notarise the document(witness the signature of the parties or notarise a true copy)and issue a notarisation certificate.
Step 2: The notarial certificate and documents are submitted to the Australian Department of Foreign Affairs (DFAT) for Apostille certification.
Timeframe
The entire process typically takes approximately 2-4 weeks. However this is only an estimate, and the actual time may vary based on DFAT’s processing times.
